Mother reacts to guilty plea in manslaughter case after son falls to his death

COLORADO SPRINGS, Colo. (KKTV) A man arrested in connection with the death of a little boy who fell at a local park is now waiting to learn his punishment.

Kyle McClain, 28, pleaded guilty to manslaughter charges for the death of 7-year-old Kaivion Eleby back in March.

Wilma Eleby, Kaivian's mother, said this came as a pleasant surprise. She was expecting a trial.

McClain is Eleby's ex-fiancee. She has some conflicting feelings when it comes to the punishment she thinks he should face.

"I think that he needs to serve some time for sure, two to three years would be a good in between," Eleby said.

She and McClain have a 2-year-old daughter together.

"I just feel like if he serves that max, that 12 years, that is two kids' lives that are ruined, my son and my daughter, because she loves her father very much."

McClain admitted to drinking hard liquor before taking Kaivion up Cheyenne Canyon. A grand jury found that the area he was hiking was obviously too dangerous for a child. Investigators tell us the boy fell 100 feet to his death.

McClain will be back in court for his sentencing on Feb. 21 at 2 p.m.
