Evidence to be tested in Patrick Frazee murder case

On Friday, prosecutors filed a motion to see if they could proceed with consumptive testing of a piece of evidence.

11 News has confirmed that evidence in question is a tooth that was found on Frazee's property by investigators.

During the hearing, a forensic specialist with the CBI testified over the phone.

The specialist said since the evidence is so small, the defense and prosecution will both have to have an expert present because it can only be tested once.

The CBI requires an expert to go through a background test and a buccal swab before they can observe the evidence. The defense objected to those requirements on Friday.

The judge agreed with prosecutors, saying that the CBI is a credited testing facility and they have a right to follow through with those tests to make sure the expert doesn't have any prior felonies or carry contaminated data into the testing room.

District Attorney Dan May said the defense has two weeks to find and submit their expert because the DNA testing on the tooth needs to be done as soon as possible.

Patrick Frazee's next court date is a motions hearing scheduled for August 23rd, 2019.

A judge ruled media will no longer be able to have access to the sidewalks where a man suspected of killing his fiance is expected to be dropped off for a hearing on Friday.

In the past, news crews have been allowed to film the suspect walking into the courtroom.

Patrick Frazee is accused of killing Kelsey Berreth in a case that has garnered national attention. He appeared in court on Thursday for a custody hearing that was kept private. He's scheduled to appear in court on Friday for his criminal case. Prosecutors say Frazee blindfolded and beat Berreth to death with a baseball bat. Berreth has not been seen since Thanksgiving Day.
