Case against teacher being dismissed

FOUNTAIN, Colo. (KKTV) - UPDATE (11/7): The case against 49-year-old Fountain-Fort Carson High School teacher Thomas McCombe has been dismissed.

The district attorney's office said there was not enough evidence to move forward.

The Fountain Fort Carson School District 8 spokeswoman told 11 News McCombe remains on administrative leave pending the outcome of their own internal investigation.

The school district did not say how long their investigation would take to complete, but said it would be done in a timely manner.

PREVIOUS (10/14): A Fountain Fort Carson High School teacher was arrested Thursday afternoon on suspicion of sex assault on a child by one in a position of trust and unlawful sexual contact.

A week ago, detectives from the Fountain Police Department started an investigation that centered around Thomas McCombe, 49. Two female students reported being inappropriately touched by McCombe. Both incidents were reported to have happened at Fountain Fort Carson High School where McCombe has been employed since 2007.

According to an arrest affidavit obtained by 11 News, 2 girls at the school told investigators their teacher’s hands touched their hips, backside and in one case the side of their breasts.

In the affidavit, it says during the investigation a male student told officers he had witnessed McCombe inappropriately touch some of his classmates. He described McCombe approaching female students from behind and putting his hands on their hips, and moving them aside before passing by.

When the allegations surfaced, a group of students made posters showing their support for Mr. McCombe.

They say they do not believe these claims, and want this resolved and their teacher back.

"Mr. McCombe is probably one of the best teachers I’ve ever had. He's a caring guy, never have I once felt that he's making me uncomfortable,” one student told 11 News.

McCombe is being held at the El Paso County Jail. Fountain Fort Carson School District tells 11 News he has been placed on administrative leave.
