Lawyers say James Holmes has offered to plead guilty.

This offer comes just days before the prosecution was expected to announce whether or not they planned to pursue the death penalty.

Under the deal, Holmes would spend the rest of his life in prison in exchange for avoiding execution.

However, it's not a done deal yet--and those impacted by the shooting are split on what they hope the prosecution decides.

The shooting happened last July, during a showing of The Dark Knight Rises at an Aurora theater. Twelve people were killed and dozens more were hurt.

The father of one of the victims told us early on that he wished Holmes wasn't alive.

Pierce O'Farrill, who was shot three times, told the Associated Press a lengthy trial would be far more stressful for the victims and their families than just locking Holmes away for the rest of his life. He said he didn't think the death penalty would bring him peace.

The ex-wife of victim Gordon Cowden said she was opposed to a plea deal.

“He didn’t give 12 people the chance to plea bargain and say, ‘Let’s see if you’re going to shoot me or not,’” Melisa Cowden said. The couple's daughters were by their father's side when he was shot to death.

Defense lawyers for Holmes say if they go to trial, they would bring up his mental state and possibly use it as a defense.

We are working right now to learn how long the prosecution has to consider this deal before they have to make a decision.

We are staying on top of this story and will let you know any new developments we learn.
