Lawsuits Over Aurora Theater Shooting Filed Against Theater Chain

Three people wounded in the Colorado theater shootings have filed lawsuits that allege the exit door the gunman used to enter the building should have had an alarm.

The lawsuits were filed against Cinemark USA Inc.

Twenty-four-year-old James Holmes is accused of killing 12 people and wounding 58 others during a special midnight showing of "The Dark Knight Rises."

Prosecutors allege Holmes left the theater through a back exit, propped the exit door open and re-entered the theater to begin the shooting.

On Friday a District Court Judge also allowed the release of redacted copies of court documents related to the investigation into the shooting. Judge William B. Sylvester ordered the “unsupression” of court files with some exceptions by September 28.

The prosecution and defense had requested the case be sealed to protect the investigation and suspect James Holmes' right to a fair trial. Sylvester noted that the limits and releasing redacted copies effectively prevents such harm.

Documents that will not be released include the arrest affidavit, which contains details of the investigation, or requests for search warrants. Other documents, including those requested be suppressed or sealed by prosecutors or defense attorneys will remain publicly unavailable.

Cinemark USA Inc. has announced plans to refurbish and re-open the theater where the shooting happened.
