James Holmes Facing 142 Counts, Including 24 For Murder


The suspect accused of opening fire in a crowded Aurora movie theater now formally faces 142 charges. That includes 24 counts of first degree murder.

For the murder charges, one count included murder with deliberation, the other murder with extreme indifference. Both carry a maximum death penalty upon conviction.

James Holmes is also charged with 116 counts of attempted first degree murder, 1 count of committing a crime of violence and 1 count of possession of an explosive device.

Holmes is accused of killing 12 people at an Aurora movie theater during an late night showing of "The Dark Knight Rises." The shooting also injured 58 others and caused one miscarriage.

Unlike Holmes' appearance in court last week cameras and electronic devices were not allowed inside the courtroom Monday. Arguments were heard about unsealing more information from the case, but many of those decisions were delayed until another hearing on August 9.

Only the felony complaint will be unsealed immediately.

Inside the hearing, Holmes was described as unemotional. When the judge asked if he approved of a delay in the bail hearing to November, he reacted as if his thoughts were disturbed. Holmes leaned to his lawyer, appeared to mouth "OK," then responded "yeah" to the judge.

The proceedings in the courtroom also revealed that prosecutors are combing through thousands of pages of reports from all the agencies and officers that responded to the scene of the shooting. Those documents will also be made available to the defense.
