A Colorado City councilman says he won't step down after he was arrested on assault charges.

Richard Brainard was recently elected in Grand Junction. Last week he was released from jail.

He has yet to be sworn in as a councilman.

The current city council wrote a letter, asking him to step down and the community agrees.

"If he can cross the edge with a person he loves and that he's supposed to protect," one council member asked, "what is he going to do to the first assertive female that challenges him?"

One councilmember opposed the vote to ask him to step down. That councilman says he has a right to be proven innocent.
