Dutch the service dog is back in custody after the owner surrendered the animal to authorities in a bid to save the dog's life.

Surrendering the dog cleared the decks for Jeremiah Aguilar to appeal a municipal court order that his service dog be euthanized as a dangerous dog and that Aguilar owner be jailed.

Dutch has been ruled a dangerous dog because of his attack on a former owner in November. A judge in Montrose sentenced Aguilar to two days in jail after Aguilar refused to give the dog to animal control officers.

Aguilar is a U.S. Army veteran who served in Afghanistan. He said his symptoms of post-traumatic stress disorder are eased by caring for Dutch.
