Defense attorneys for a Fort Carson soldier charged with murder in the death of his nephew are asking for the charge to be downgraded to involuntary manslaughter.

The Gazette reports the request came Thursday as testimony wrapped up in a military hearing for Pfc. Jason A. Price. The hearing will help determine whether Price should face a court-martial in the death of 2-year-old Kevin Rosa Perez, who died in November of blunt force trauma to the head.

An Army investigator testified earlier this week that Kevin's brother had said Price had thrown Kevin against the kitchen floor.

But Price's attorney, James Culp, says the translator who interviewed the brother wasn't trained to interview children. Culp says the brother also had said Kevin fell earlier in a bedroom.
