A rape case against an Air Force Academy cadet is set to start Monday, after being delayed last week.
The hearing and the supervising officer’s report will determine if he case goes to court martial.
According to an affidavit released by the AFA, Cadet Robert M. Evenson Jr., a 2011 graduate, raped a fellow cadet between March 1 and July 1 of 2010. The rape charges include additional specifications of aggravated conduct and indecent acts, which according to the affidavit include Evenson holding a woman down while masturbating over her, and engaging inappropriate sexual conduct while forcibly restraining the victim.
The charge papers indicate he is suspected of abusing his position as the Cadet Non-Commissioned Officer for Honor by helping a cadet in exchange for a dating relationship and sexual favors.
The charges against Evenson include two counts of rape, engaging in an unprofessional relationship and conduct unbecoming an officer.
The Air Force explains an Article 32 hearing as the equivalent of a civilian grand jury proceeding. An investigating officer, who is typically a Judge Advocate, presides over the hearing and submits a report to the Superintendent, who is the installation general court martial convening authority. The Superintendent will then decide if the case will go to trial.
