Prosecutors will seek death penalty against Colorado theater shooting suspect James Holmes.

The judge in the case has also delayed the trial until next February and acknowledged even that date might be pushed back.

The district attorney says he made the decision to pursue the death penalty after reaching out to 800 victims and family members, personally speaking to 60 of them.

Supporters of Holmes broke out in tears in the courtroom after the announcement was made, according to sister station KCNC.

Last week, the prosecution angrily rejected an offer by Holmes' defense team for the 25-year-old to plead guilty in order to avoid the death penalty.

The offer resulted in a public quarrel between the prosecution and defense, with the prosecution accusing Holmes' team of a serious breach of court rules by making the offer public. According to court documents, the prosecution also accused the defense of continuing to deny them the information they need to evaluate a plea offer.

The court documents did not disclose what information the prosecution was seeking from the defense.

The original judge presiding over the case also announced Monday that she is stepping down due to time constraints. The case is now under the direction of Judge Carlos Samour.
