87-Year-Old Fires Warning Shot At Intruder

We’re hearing from the family of a man whose home is at the center of a scary late-night encounter with a total stranger.

Police say a man was so intoxicated he thought he was trying to get into his home, which is actually a block away.

But the elderly homeowner thought he was a burglar, so he fired a warning shot through his front door.

It happened around 1 a.m. Saturday off West Platte Ave in Colorado Springs.

A drunken man mistook the house for his. Knocking on the door turned into pounding, then running charges as he tried to get in, using the full force of his body to bust it open.

Actions that terrified the 87-year-old homeowner and his 80-year-old wife who live there.

After warning him verbally, the elderly man fired a warning shot, through his front door, right above the drunken man’s head.

"If you're gonna protect your family, you gotta do what you gotta do,” said Neighbor Joseph Roybal.

Neighbors 11 News talked to in the area say they support the homeowner’s actions.

Joseph Roybal who lives down the street says he would have done the same thing.

"If it did come to that I would shoot them. I'm not a violent person, at all, but I believe my house is my home and it shouldn't be invaded like that,” said Roybal.

The homeowner’s son tells 11 News the couple is still shaken up, but no one was injured. They replaced their door with a new one.

Neighbors say this isn’t the first time an intoxicated person has come pounding on their doors in the middle of the night, but they hope it will be the last.

Police took the suspect away but right now have not charged him because they believe it was an accident.

However because the elderly man fired a shot through his door and not when the intruder was inside his home, he could face charges, because that doesn’t fall under the “Make My Day” Law.

That will be up to the District Attorney’s Office. Right now police say no charges are pending.
