The man, who is reportedly linked to the accused killer of Colorado DOC Director Tom Clements, is back in court as he prepares to go to trial next month.
James Lohr is facing several charges including vehicular eluding, possession of a weapon by a previous offender, and tampering with evidence.
Lohr was wanted for questioning after Clements was gunned down. Authorities believed Lohr was part of the 211 gang and was connected to Evan Ebel, the man accused of killing Clements.
Lohr was arrested back in April, after a leading police on a high speed chase.
His attorney asked a judge on Thursday to move the location of the upcoming trial because of all the publicity in this case. Lohr is concerned it will be hard to find an impartial jury.
The judge denied his request. The judge said there is interest in this case statewide, and there will likely be publicity no matter where the trial is held.
The judge said that lawyers might be allowed more time during jury selection to question potential jurors to make sure they are impartial.
The prosecutor told the courtroom he is not planning to bring up Tom Clements' murder during the trial.
Lohr's trial is set to begin at the end of October.
