Interview Recordings Missing In Detra Farries Case
A trial is scheduled to begin next week for the woman accused of dragging a tow truck driver to his death, but could be delayed because multiple copies of important interviews are missing.

Missing evidence could put a hold on the case against a woman accused of dragging a tow truck driver to his death. Detra Farries’ trial is scheduled to begin next week, but her attorneys are raising concerns about the missing recordings of two crucial interviews.

In February, Allen Rose was killed when Farries allegedly drove off in her SUV as it was in the process of being towed, dragging Rose for more than a mile through the streets of Colorado Springs. Rose eventually came loose from the SUV and landed in the street, dying a short time later.

Farries appeared in court Wednesday as her defense argued about the DVDs that were reportedly lost. They say the prosecution is required to hand all evidence over to the defense, but instead of the disks, lawyers handed over a transcript written by the interviewing officer.

The defense is questioning the accuracy of those transcripts, saying they need to see the DVDs to know the documents are accurate.

In response, the district attorney's office says they’ve searched everywhere but couldn’t find the missing disks.

A CSPD detective explained to the court that interviews are recorded onto a hard drive and later burned onto four DVDs. The detective suggested that perhaps instead of being lost, those disks were never made.

The defense attorney, however, pointed out that the officer’s report actually said the disk was included.

The judge did not make a ruling on the matter Wednesday, instead asking to meet with the detective himself.

CSPD spokeswoman Barbara Miller said in a written statement that dictated interviews are automatically deleted due to the limited capacity of the department’s computer system. “I can tell you that human error can occur, but it is never intentional,” she wrote.

For now, jury selection for this trial is scheduled for Monday.

When the trial does begin, it will include a “scene view” for jurors. They will be taken out to the area where the fatal dragging occurred, and they’ll walk through the alleged sequence of events. During this time, the Allen Rose memorial will be covered by a tarp so as to not influence the jury.

Wow, I can't believe what a sin sick world we live in. Whatever happened to innocent until proven guilty? The question is not if this happened, rather was it deliberately/intentionally done? Prior to "JUDGING", ask your self a few questions, starting with what if this were me? Regardless the life of the young man cannot be returned. Here is a very unfortunate situation. This lady has children, and has to live with the facts..someone did die. That alone is punishment. Here we can't even say let the jury decide, as this case is tainted any way you choose to view it. How many want to be on the jury just to have a convicting voice? How do you show remorse on your face? This woman is numb. We are all mere mortals, this could have happened to anyone.
