The Colorado Springs man that was convicted of killing his three children in a fire is trying to get a new trial.
Timothy Nicholls is saying he was poorly represented in a 2007 trial, where he was convicted of the murder of his 11, 5 and 3-year-old children.
His wife was convicted of murder in 2008, in a separate trial. She is serving out a life sentence for the crime.
Thursday in court, a fire expert that testified in the 2007 trial said his opinion hasn't changed changed about the fire. He testified that the scene he examined was well documented. He also said the fire started in multiple locations and it was started intentionally.
The judge won't make any decisions until after January 21. That is when attorneys on both sides will submit written briefs of their cases.
