Fort Carson Soldiers Charged

We have more information about the four Fort Carson soldiers who are facing criminal charges in connection with alleged abuse of Iraqi detainees. Three have been charged with manslaughter, and one has been charged with assault. They are all assigned to 1st Battalion, 8th Infantry Regiment, 3rd Brigade, 4th Infantry Division at Fort Carson.

The soldiers are accused of forcing two Iraqi detainees to jump off a bridge over the Tigris River north of Baghdad last January. One of the men did not survive. Back in May, a spokesman for Fort Carson initially said both of the Iraqi men had been able to get out of the river.

First Lieutenant Jack Saville and Sergeant First Class Tracy Perkins have been charged with manslaughter, assault, conspiracy, false statements and obstruction of justice. Sergeant Reggie Martinez has been charged with manslaughter. And Specialist Terry Bowman is charged with assault.

KKTV 11 News contacted Bowman's family members in Missouri, but they refused to comment.

A pre-trial investigation, or Article 32 investigation, will be held at Fort Carson next week. At that hearing, the prosecution only has to demonstrate there is probable cause and sufficient evidence to proceed with a case.

"Probably because is a very low standard. It's rare they would find there is no probable cause," says a former Judge Advocate General from Fort Carson. Mike Duncan says the four accused soldiers will likely face a general court martial. "It's certainly a serious accusation, but it's an accusation. And even though they're in the Army, they're presumed to be innocent. The prosecution has the difficult burden of proving their guilt beyond a reasonable doubt."

Duncan also says the accused soldiers will be appointed military attorneys. They can also hire civilian attorneys at their own expense.
