No Death Penalty

Opponents of the capital punishment think a decision to spare an accused killer in Colorado Springs could signal changing attitudes in the state.

Prosecutors in the murder trial of 26 year-old Anthony Jimenez say they won't seek the death penalty.

Jimenez is charged with first-degree murder for the death of 16 year-old Jennifer Baker. His first trial ended in June with a mistrial.

A 2002 U.S. Supreme Court decision forced death penalty decisions back into the hands of juries instead of judges.
