Quack Controversy

The owner of a duck accused of quacking too much won't be going to jail.

Manitou Springs resident Lou Smith could have faced a
thousand-dollar fine and 90 days behind bars for violating the
city's noise ordinance.

Smith's next-door neighbor said the quacking of the European
buff-crested duck named Homer was keeping her from working. But
Smith said that according to his ``Quack Log'', Homer has only
averaged 7-point-8 quacks a day since May.

A judge said he wasn't convinced the quacking was continuous and
loud enough to constitute an unreasonable noise.
