Laser Pointer Lawsuit

Thirteen-year-old Mitch Muller and his mother Lova Zahary filed
the lawsuit on Friday in district court. The suit seeks to clear
Muller's record, and asks for attorney fees and other costs.

A teacher at North Valley Middle School caught Muller playing
with the laser pointer during class November 19th and reported him
and two other boys to the principal.

Muller was expelled for one year, a decision that was upheld by
the school board. He completed a six-week alternative program that
allowed him to return to school January 20th.

His attorney claims Muller's due process rights were ignored and
that the district violated Colorado's open meetings law.
