The 10th U.S. Circuit Court of Appeals has blocked the military at least temporarily from arresting a civilian counselor who has refused to turn over records of sessions with a former Air Force Academy cadet who says she was raped.

Wendy Murphy, lawyer for Jennifer Bier, said the court gave the government until Wednesday to file a brief. Murphy appealed to the 10th Circuit when a federal judge in Denver declined to issue an order blocking her client's arrest.

Jeff Dorschner, spokesman for the U.S. Attorney in Denver, said the government is reviewing the appeal and will respond.

The counselor's records are sought in the court-martial of 1st Lieutenant Joseph Harding, who is accused of raping two female cadets while at the academy.
