DA: Police Justified In Using Deadly Force During Chase

Colorado Springs police were justified in using deadly force during a dangerous chase across the city last April. No one was killed, but one of the suspects broke an arm when their vehicle rolled.

Afterward, Police arrested Michael Peyton, 20, Travis Broadway, 21, and Parice Daily, 23.

Investigators said officers were called to check out a reported stolen car on the morning of April 7. The car was in the parking lot of a strip mall on South Academy Boulevard. Police believe the men in the car were about to hold up one of the businesses when they arrived.

When officers tried to stop the car, the driver sped away. Police gave chase, and report one of the men fired an AK-47 assault rifle at them at least 20 times, hitting a patrol car and a car belonging to another driver.

Police followed the suspect vehicle along a route that took them to Powers Boulevard, Carefree Circle South and back to Constitution Avenue. The chase reached speeds of approximately 100 miles per hour.

The driver also stopped several times during the pursuit. At one point police report two officers on foot fired at least four times at the suspects’ vehicle. None of the three suspects were hit by those shots.

Eventually, one officer performed a tactical vehicle intervention that caused the suspect vehicle to roll. Daily broke his arm in the crash. No one else was hurt.

The District Attorney’s Office says that the officers were justified in their use of force. That is covered under state statutes that allow an officer to use deadly force if he or she reasonably believes that is necessary to defend himself or a third person from what he reasonably believes to be the imminent use of deadly physical force, or to effect an arrest of a person he reasonably believes has committed or attempted to commit a felony involving the use or threatened use of a deadly weapon, or otherwise indicated that he is likely to endanger human life or to inflict serious bodily injury to another unless apprehended without delay.
