 Lawyers in the Colorado theater shooting case are arguing over an FBI-built model of the crime scene that prosecutors want to show jurors.

Lawyers in the Colorado theater shooting case are arguing over an FBI-built model of the crime scene that prosecutors want to show jurors.

In a motion released Friday, prosecutors say the model should be allowed without a hearing. They were responding to an earlier defense motion questioning the reliability of the model.

The model depicts the theater where 12 people were killed, an adjacent theater and part of the exterior. Prosecutors say it will help jurors visualize the scene of the 2012 attack.

Defense lawyers say the model was damaged in shipment and some of the repairs aren't to the original scale. They're seeking a hearing.

James Holmes is scheduled to go on trial in October. He pleaded not guilty by reason of insanity. Prosecutors are seeking the death penalty.
