AURORA, Colo. (KKTV) A strange twist in the next phase of the movie theater shooting spree: the killer is convicted, but no one knows where he is locked up.
Opening statements for the civil lawsuit against the Aurora theater will happen Tuesday. Some of the victims' families say the theater's parent company didn't do enough to make the theater safe. On Monday, a jury was picked for the case.
The families' lawyers want to interview James Holmes as part of their case, but they can't find him. He's been moved to an out-of-state prison.
In an 11 Call For Action investigation, reporter Katie Pelton is looking into why that was done, and why even the lawyers can't get answers.
We've been investigating this missing Holmes situation for months. We know Holmes was moved to a different prison in January, partly because he got attacked by another inmate. His location has been kept a secret.
11 News sat down with the prosecutor in the Holmes case. Even he doesn't know where Holmes is, and he's not happy about it.
"I'm frustrated," said District Attorney George Brauchler. "This is a guy that was brought to justice in this community for murderous acts he committed in this community, against people who live in this community. He ought to be serving his time in this state."
