The Fremont County district attorney is trying to recuse himself from an assault case involving a city councilman.
District Attorney Thom LeDoux told 11 News that Canon City Councilman Michael "Colby" Katchmar supported his campaign in the past, causing a conflict of interest. He has filed a motion requesting that a special prosecutor take over the case.
If a judge grants the request, the Pueblo County district attorney will likely take over.
Katchmar, 54, and local artist Thomas Lockhart were arrested last week after they allegedly assaulted an older couple at a wine tasting on Main Street in Canon City. The victims, 70-year-old Robert Martin and 65-year-old Margene Martin, accuse the men of attempting to block them from leaving the restaurant, while in the arrest affidavit, Katchmar says the couple attacked him first. He has issued a statement saying the incident was likely politically motivated.
Authorities say Margene suffered several serious injuries in the incident, including a fractured hip.
Katchmar was in court today for a bond hearing.
