It's your decision 2010, and 11 News is clearing up a campaign tactic that's caused some confusion in the race for governor.

There are two men in the public eye in Colorado with very similar names. Dan May is the 4th Judicial District Attorney. Dan Maes is a Republican running for governor against Scott McInnis.

In the past when the two Dan's had their names mixed up, it was comical. But this week, candidate Dan Maes says it stopped being funny when a call went out from Dan May.

"I am District Attorney Dan May, and while I'm not running for governor, I am a strong supporter of Scott and ask you to join me in voting for Scott McInnis as our next Colorado governor." That was the message in an automated campaign call that went out to registered Colorado Republicans on Tuesday. It originated from the McInnis campaign headquarters, but it caused confusion and concern for voters supporting Dan Maes, McInnis' competitor in the primary.

Candidate Dan Maes said, "Someone felt that there was a second, different robo-call going out saying, 'This is the Dan Maes campaign headquarters. Dan Maes has decided to drop out and support the other candidate'."

Now, it's become clear that there was just one automated call, but that some people misinterpreted it. The McInnis campaign says District Attorney Dan May wanted to record the message, because May gets approached all the time by people thinking he's running for governor.

May wanted to clarify who he is and that he supports Scott McInnis.

Despite this clarification, gubernatorial candidate Dan Maes says the whole thing still strikes him as a dirty campaign tactic.

"I believe that the Dan May message is very intentional," said Maes. "And although legal, I would question the ethicalness of it. There is no doubt in my mind that there is an attempt to confuse with that message."
