The Colorado Supreme Court has refused to hear an appeal of a key ruling in Kobe Bryant's sexual assault case---essentially dealing another setback to prosecutors.
District Judge Terry Ruckriegle ruled last month that the defense can use information about the woman's sexual activities near the time of her encounter with Bryant at his trial. Justices did not explain why they refused to consider the appeal.
The order was released as Bryant's final pretrial hearing got under way. Prosecutors suggested they had concerns about the way laboratory personnel handled DNA evidence in the case.
Ruckriegle told both sides to submit lists of lab employees they want to call as witnesses, and said he'll decide later who must testify.
Bryant has pleaded innocent to felony sexual assault. The Los Angeles Lakers star -- who turns 26 on Monday -- is scheduled to stand trial beginning next week, with jury selection starting August 27th.
