Lawyers for three Fort Carson soldiers charged with pushing two Iraqis into a river say prosecutors are hurting their case by refusing immunity for three potential witnesses.
Defense attorneys say the soldiers' commanders are demanding immunity before they'll testify at a hearing to determine whether the soldiers are court-martialed.
The commanders were all given nonjudicial punishments for allegedly conspiring to impede the investigation into the drowning.
That means they did not face criminal charges or jail time.
The officer presiding over today's hearing ordered prosecutors to explain whether they offered immunity to defense witnesses and why.
Prosecutors did not immediately respond.
Two prosecution witnesses have already been granted immunity.
The soldiers are all assigned to the Third Brigade Combat Team based at Fort Carson, Colorado.
The brigade is part of the Fourth Infantry Division based at
Fort Hood, Texas.
