An attorney for a Washington man accused of threatening a Colorado abortion doctor says his client is planning to plead guilty.
Seventy-year-old Donald Hertz previously rejected a plea deal in February and asked for a trial on allegations that he called the Boulder Abortion Clinic in June and threatened to kill members of Dr. Warren Hern's family. The alleged threat came within weeks of the slaying of Dr. George Tiller, who operated an abortion clinic in Wichita, Kan.
Hertz's attorneys said this month that he had reconsidered his decision to go on trial. Hertz attorney W. Russell Van Camp said Friday his client would plead guilty under an agreement with prosecutors.
A hearing is set for Monday but Van Camp says it may be postponed because Hertz has the flu.
