D.A. Clears Deputy in Shooting at Springs Wal-Mart
The Fourth Judicial District Attorney's investigation into a shooting involving an El Paso County Sheriff's deputy finds the shooting was justified.

The Office of the District Attorney and the Colorado Springs Police Department complete their joint investigation into an officer involved shooting.

Deputy Glenn Boarman and Sgt. Maxwell were attempting to arrest a fugitive In December 18, 2009 in the parking lot of a Wal-Mart store at 3201 E. Platte Ave when one of the deputies shot at a suspect.

The suspect, Joshua Kenyon, reportedly was driving a stolen vehicle when the two deputies approached. Kenyon then accelerated heading straight for the deputies.

When the suspect did not stop Deputy Boarman fired one shot striking the windshield of the suspect vehicle, no one was injured in the incident and Kenyon was arrested on outstanding warrants.

The investigation and legal analysis of this shooting has been completed, and the 4th Judicial District Attorney’s Office concludes that under Colorado law, Deputy Boarman was justified in using deadly force against Mr. Kenyon.

If they had stopped to think, there are only 4 exits to Walmart. Take him down, away from the crowd. Spike strips could be very helpful. The business it cost Walmart is in the Millions of dollars. The officers should be held liable for this. To just approch a crimminal in a busy public parking lot, shows lack of training. Do you want some names of sheriffs officers, involved in drug trafficing? Just keep defending them.

I agree with Andy. I would like you to tell me when a DEPUTY shot an inocent person, destroyed the wrong property, or did anything that didn't keep the public safe. I'm sorry if you reported illegal weapons and didn't get the help you wanted, but that wasn't from the Sheriff's Office. With the budget cuts going on, we hardly have the staffing to handle everyday calls, but you still see deputies seizing meth labs and that sexual perp that lives next door! So pay attention who you are talking about before running your mouth.

They keep us safe? Statics: Police nationaly cause over 1000 serious accidents every year. They have a history of distroying the wrong property. Shooting inocent people. You call that safe? In 2003 I gave them the info on a "transfer man" on the DIA tarmac, transfering illegal weapons and explosives from plane to plane that the public flys on, he has since moved on to many different airports. The police looked the other way. A Meth lab stayed in business because of an officer accepting sexual favors to look the other way. You want names? And remember our DA driving under the influence in a vehical paid for with our tax money? Now stand there and defend them? How about drug use, and alcoholism by our judges? Should I post names, dates and places? I have spent 7 years collecting inside information on the system. Be afraid.
