Man's Time Behind Bars Is Little Justice To Victim's Family

While the rest of us are singing "Auld Lang Syne," Juan Maldonado, 48, will be sitting behind bars; just days into a four year sentence handed down Monday.

Maldonado is serving his four year sentence as part of a plea agreement reached he reached with the Pueblo County District Attorney's Office. He agreed to plead guilty to his original charge of contributing to the delinquency of a minor, in exchange for a four year prison sentence. The charge could have put him behind bars for two to six years, or more if the judge found aggravating factors to be present.

With an extensive criminal history crossing several states, Maldonado has made poor decisions in the past but has been on the right side of the law for the last 10 years.

On May 12, 2009 Maldonado and his son went fishing. After realizing he was too drunk to drive, Maldonado allowed his son (a 15 year old boy without a license or permit) to drive him home. On their way back, the boy pulled out in front of Gregory 'Griz' Robinson, in the intersection of East 8th Street and Glendale. Robinson was test driving a customer's bike at the time. The accident put Robinson in the hospital. A week later, Robinson died from his injuries.

Since then, Robinson's family has been searching for justice. Griz left behind a wife and two daughters, one in college the other a senior this year. Their loved one's sudden death will affect them the rest of their lives and in their opinion Maldonado should be held responsible for the rest of his life.

Because Maldonado was not driving, the District Attorney's Office felt the only charge they could conceivably get a conviction was a felony charge of contributing to the delinquency of a minor. Robinson's family and friends are not pleased with the justice system because of this.

District Court Judge Thomas Flesher addressed Maldonado at his sentencing Monday. Flesher told the defendant he had made many bad choices in his life, but none may have impacted as many people as the one to allow his son to drive that day. Flesher also expressed his difficulty in deciding whether or not to accept the agreement Maldonado had with the District Attorney's Office. He cited Maldonado's extensive criminal history as giving him significant trouble.

In the end, Flesher accepted the deal and sentenced Maldonado to the four years agreed upon. Maldonado will also serve three years of probation after he gets out of prison. Finally, Flesher addressed Robinson's family to express his hope that they are able to find closure even if he couldn't provide the justice they were hoping for.

Outside the courtroom, after Maldonado was taken away in handcuffs, Robinson's wife Denise said, "I don't believe his sentencing was enough. I believe Griz's life was worth a whole lot more than that. I believe in karma and I know [Maldonado] will get his."

The Robinson family expects Maldonado will serve less than a year in prison before being released on parole.

Prayers with the Robinson family and even Maldanodo's son. As for Juan...I would have hoped this death that could have been prevented would have weighed heavily on your conscious, but it sounds like you don't have one!
