Funding Feud

At issue is who has the right to spend millions of dollars in money the government sends to the state each year. Owens says it's his right, and the lawmakers say it should be up to them.

The fight began over $146 million the state received last year as part of President Bush's tax-cutting plan. Owens handed out the money to various programs, angering lawmakers who said he can only handle federal aid for specific programs such as
Medicaid.

The court did not indicate when it will issue a ruling.

After the hearing, Democratic House Minority Leader Andrew Romanoff said he thinks the lawmakers will win. He says the court understands that lawmakers are not -- quote – “just a bunch of potted plants.''
