The Pueblo Police Department is facing a wrongful death lawsuit, filed by the family of a man who died as police tried to arrest him.
In May 2002, police confronted Richard Barella after receiving complaints he was jumping in front of cars. Officers say they were forced to use a tazer gun, when Barella refused to cooperate.
Barella's parents believe police hog-tied their son, put weight on his back, and pepper sprayed him, all after he'd stopped breathing.
According to the autopsy report Baralla died of a heart attack. He had not evidence of drugs or alcohol in his system.
