School Vouchers "Unconstitutional"

A judge has ruled Colorado's fledgling school voucher law unconstitutional, saying it illegally removes local control over education.

A coalition led by a teachers' union contended the school voucher law undermines a constitutional requirement that the state provide a free and uniform public school system.

The state said the law would provide opportunities to thousands of children whose parents can't afford to remove them from public schools.

Denver District Court Judge Joseph Meyer issued an injunction, barring implementation of the voucher plan. The Institute For Justice says the ruling will be appealed.

The Colorado law was the first enacted since a U.S. Supreme Court ruling upheld Cleveland's school voucher program as constitutional.
