A company looking to bring radioactive waste from New Jersey is bypassing the director of the Colorado Health Department to get the plan approved.

Directors of the Cotter Uranium Mill near Canon City want to bring in the 470 thousand tons of contaminated dirt to cover radioactive holding ponds.

The company petitioned the 9-member board of the Colorado Department of Public Health and Environment to approve its plan instead of waiting for department director Doug Benevento.

The board will hear the petition request Wednesday in Denver.
