New Trial Granted In Woman's Lawsuit Against Railroad
The state Supreme Court said Monday that Union Pacific Railroad should be able to bring up evidence regarding what role Missy Martin and her then-boyfriend may have played in the collision in Castle Rock.

A new trial has been granted in a lawsuit filed by a young woman severely injured in a collision with a coal train.

The state Supreme Court said Monday that Union Pacific Railroad should be able to bring up evidence regarding what role Missy Martin and her then-boyfriend may have played in the collision in Castle Rock.

Martin and her family won an $11 million verdict against the company in 2005.

Martin was 16 and on her way to school when her car stalled at a railroad crossing in 2002. Her boyfriend, driving behind her, tried to push her off the tracks with his pickup but the train broadsided her vehicle.

According to its Supreme Court arguments, the railroad is prepared to argue that the boyfriend may have put Martin more directly in the path of the train.
