A federal judge has issued a temporary restraining or er against a new Colorado law requiring students and teachers to recite the Pledge of Allegiance.

U-S District Judge Lewis Babcock says the law requiring the pledge discriminates against teachers by allowing students to opt out with a note from their parents.

He also called the law divisive because it pits students who choose to say the pledge against those who do not, as well as students against teachers.

Nine students and teachers filed a lawsuit over the law which took effect August Sixth.

Attorney General Ken Salazar had said the law was constitutional because anyone can choose not to participate under certain circumstances.
