The court turned down the Bush administration's request to
consider whether the federal government can punish doctors for
recommending marijuana -- or even for just talking about its
benefits.

An appeals court says the government can't punish doctors.

Alaska, Arizona, California, Colorado, Hawaii, Maine, Nevada,
Oregon and Washington have laws legalizing marijuana for people
with a doctor's recommendation.

Federal law bans pot under any circumstances.

The case pitted the free speech rights of doctors against
government power to stop them from encouraging marijuana use. A
ruling for the Bush administration would've rendered state medical
marijuana laws useless.
