Prosecutors say 48-year-old Ernie Medina planned and
participated in the hunt for the car that 13-year-old Gino Romero
died in.

Medina's gang retaliated after two of its members were fired at
by rivals in 1997. The gang members in one car spotted the person
they believed had fired on them and they fired numerous shots into
that person's car. One shot killed Romero, who was from Colorado
Springs.

A federal appeals court ruled Medina was not in the car where
the shots came from. Medina's lawyers argued he was at home eating
pizza and had no part in the crime.
