Barton Appeal Denied

The judge who sentenced Terry Barton on state arson charges has rejected a request to remove himself from the case. District Court Judge Edward Colt issued an order this morning denying the motion for recusal and vacation of sentence.

Attorneys for Barton had said he should have taken himself off the bench because the Hayman fire personally affected him. He told the courtroom before sentencing March fifth that he had to leave home after seeing heavy smoke from the fire.

Colt sentenced Barton to the maximum of 12 years in prison on state charges stemming from the 138-thousand-acre blaze. Colt's order today says the law does not require judges to withdraw from their communities and doesn't prevent them from helping with relief efforts.
