A 12-year-old hit by a car is recovering in a hospital; his mom is now calling for changes to make the area where they live safer.

The accident happened near Sand Creek Elementary on Airport Road where there is no crosswalk and no school zone and that's because Airport Road is the district boundary between District-11 and District-2 and so kids shouldn't have to cross the road. But 12-year-old Darius Irving’s mother says, bottom line, with a school nearby this area needs to be safer.

Darius has his left leg in a cast, his forehead is pretty scratched up, but he’s in good spirits, he's just thankful to be alive.

"This gray car just rammed into me," Darius said.

A 7th grader at Panorama Middle school, Darius was on his way to his bus stop, which is across a busy Airport Road at Sandcreek Elementary. He says he crossed the street and next thing he knew he was lying on the ground.

"I remember the ambulance came and got me up," Darius said.

He had to undergo surgery for a badly broken leg.

"I was so scared," said his mother, Teresa Washington.

She is just glad his injuries weren't worse.

"He's very lucky to be alive, he was in the middle of the street, halfway across Airport," Teresa said.

A street that Teresa says needs some changes.

"There's no crossing guard or crosswalk across Airport where it's incredibly busy," Teresa said.

A District-2 spokesperson says the reason there is no crosswalk or school zone here is because Airport Road is the district boundary. Darius is a D-2 student who actually lives in District-11, but his mom says with the ongoing development happening here, many kids cross this street everyday.

"Lots of kids cross over to go to the park, playground, to school," Teresa said.

And she doesn't want any other parent to go through what she and her son have.

Police say the woman who hit Darius was not speeding, but the speed limit is 45 mph. She was not cited.

Im with WHO ARE YOU 100 percent. I am friends with this childs mother and agree that non of you know the whole truth. The only truth I see is the pain in her eyes when she talks about her injured son. This is someones baby, and all of our hearts should be going out to him as well as our prayers. Not nasty comments and blogs.

As the mother stated that is a busy intersection, and the city should do something to make it safe. Those with negative comments I will pray for you, think about how you would feeln if this was your child.

Sandcreek... what does illegal immigrants have to do with this specific story? Not having a valid drivers license doesn't mean they're an illegal immigrant.

Posted by: sandcreek Location: sandcreek on Sep 5, 2008 at 12:47 PM
Parents have a responsibility to teach their children what to do and what not to do. Drivers have a responsibility to obey traffic laws. Local authorities (police) have a responsibility to do something about people who don't obey the laws. With the influx of illegal immigrants into our city and others.....great efforts should be taken to get them out.

Neverless this city needs to do something about the way people drive in school zones and residental areas! I've seen sevral close calls in my area. Lord have mercy if it's ever my children! And if your going slow in a school zone or neighborhood, the jerk behind you is on your tailend the whole time because he thinks his destanation is more important than anyone else! Come on people, SLOW DOWN!

How interesting that you mention the police blotter. It is under reinvestigation by CSPD to see if it is accurate. They are meeting with the family to go over the facts. There is no crosswalk at that location only a stoplight with no sidewalks - knee high grass and huge fire ants which make crossing at the UNMARKED LIGHT difficult at best. Plus the speed limit is 45!

After reading what actually happened, I agree with Anon. The child was in the wrong and is lucky he was not injured more seriously or killed. I do feel sorry for him yet maybe he learned a hard lesson. I also agree that the person who hit him should have had her vehicle impounded immediately if she were driving illegally...no if's, and's or but's!! It does seem that the mom is blaming the city for something for which she and her son were responsible and I'm not sure the city deserves criticism in this case. He acted impulsively as do most kids and it was an unfortunate accident. Thank God he'll recover from his injuries. I want to reiterate that the person who hit him should not be driving her vehicle... this is a huge mistake by the police! Please get her off the roads!!

I KNOW THIS CHILD,S FATHER. NONE OF YOU KNOW WHAT HAPPENED. ITS SAD THAT YOU ALL HAVE NOTHING BETTER TO DO THEN TO PASS JUDGEMENT ON THINGS YOU HAVE NO DIRECT INFORMATION ON. HE IS A CHILD. HE WAS INJURED. IT DOES NOT MATTER THE CIRCUMSTANCES. HE SHOULD BE IN YOUR GOOD THOUGHTS, NOT YOUR NASTY BLOGS.

Straight from the CSPD Blotter: "A vehicle driven by a 33 yoa female was traveling Westbound in the 4900 block of Airport Rd. when a 12 yoa male ran South across the street. The vehicle struck the child with it's right fender and mirror. The child suffered a broken left leg and contusions and bruises. He was transported to an area hospital by ambulance. Witnesses stated the child did not look before he ran into the road and the driver was not speeding when the accident occured. The driver was not cited for causing the accident but was cited for not having a valid driver's license." I feel bad for him being hit, but why was he running out in traffic without looking? There is a crosswalk literally yards from where he was hit, and any parent should have tought him to cross there instead of the middle of the road. The driver should have never been on the road either since she was driving without a valid license, and should get more than a slap on the wrist for it!

I just read the police blotter on this and it states the boy did not look before he ran across the street, nor was he in a crosswalk. I don't understand how the mom let him cross by himself if she felt it was such an unsafe area. I drive my 12 yr old and 13 yr old neighbor to school because he would have to cross Powers and also Fountain and IMO it is just too dangerous. You won't see me on the news after-the-fact complaining about the intersection being dangerous.

I drive this road every morning, and see the kids at the bus stop. There is a stop light with a cross walk within yards of where they wait. It doesn't sound like this young man was in the crosswalk. I'm very careful when I drive past. It's not unusual to see a young person walking in the street, or sitting on the curb with their feet in the street. I'm sorry that this happened to this young man, but the parents of these kids need to make sure they are being responsible as well.

Native... what a stupid comment to make. You don't know if that was even the case.. AND even if it was what happened it doesn't mean he deserved to get hit by a car. You're a moron.

Posted by: jamie Location: springs on Sep 4, 2008 at 08:02 AM
you pro bably was the one who hit him native why say something so mean like that do you have kids what if one of them were hit

Posted by: karen Location: c/s on Sep 4, 2008 at 07:43 AM
no one wants to take blame for it but this is a safety issue, not throwing blame on others. just listen to these parents concerns and address them to make our children going to school safer.

I feel so bad for Darius. I'm praying for him. Why don't they put a crosswalk there. And here in Colorado people don't pay attention to crosswalks like they do in Utah. Please do something OK.

Posted by: Native Location: CS on Sep 4, 2008 at 07:10 AM
It's a shame that children are not safe because they live on what is to be considered a boundary line. D-2 or D-11 what does it matter. The city officials need to get on this one. Native you are as ignorant as they come.

Sounds like a child endagerment charge needs to be made against mom. If her child had been going to the right district, he would not have had to cross Airport. Mom set him up to fail, as she offered no supervision of safty.

This was bound to happen. There is a stop light with pedestrian crossing not far from where the accident happend. I have seen too often to where parents show kids that it is ok to cross the street anywhere even if a pedestrian crossing/cross walk is within a hundred yards. Don't get me wrong I feel sorry for the kid for getting hurt. Parents need to wake up and teach their kids proper street crossing methods.

Posted by: A Location: COS on Sep 4, 2008 at 05:07 AM
OK. So of Airport is the district boundary, but kids still have to cross there because of development or construction, why doesn't the city "break down" for the safety of our children and put something temporarily there so they at least have attempted to improve and create a safer passage? Boundaries, "It's not my problem"...every child is our responsibility!

the kid should have paid atention to the traffic and not to his phone or games
