A second mistrial has been declared in the case of a Colorado Springs man charged with murder and kidnapping.

A judge on Monday halted the trial of Salvator Esquivel-Castillo because defense attorneys revealed they had obtained a pair of shoes that could be evidence in the case but hadn't told prosecutors about them.

A mistrial was declared last month because prosecutors were late giving defense attorneys a report by an expert.

The 36-year-old Esquivel-Castillo is accused of kidnapping and killing 22-year-old Jaclyn Funderburg of Colorado Springs in July 2007. The couple had a son together.
