The House has rejected Senate amendments to a bill that would make it tougher to sue over housing construction defects saying some changes proposed by Attorney General Ken Salazar are unacceptable.
Now the proposals will go to a conference committee.
As it left the Senate the bill would cap triple damages at $250,000, including attorney fees. But Representative Greg Rippy says including attorney fees under the cap would hurt homeowners because any money they win could get wiped out by attorney fees in big cases.
Builders say a 2001 law allowing for triple damages in some cases has resulted in sky high insurance.
