The state Senate has given tentative approval to a bill that would make it tougher to sue over housing construction defects after accepting changes sought by Attorney General Ken
Salazar.
The bill now would keep triple damages but cap them at
250-thousand dollars plus attorney fees.
The bill passed on a voice vote and faces a final reading before
going back to the House to consider whether to accept the changes.
Builders say a 2001 law that allows for triple damages against
builders found guilty of fraud has led to skyrocketing insurance
rates, so they lobbied lawmakers heavily for reform.
