Ft. Carson Court Martial to Continue

A military judge has rejected a defense lawyer's request to dismiss a murder charge against an Army officer, accused in the suffocation of an Iraqi general.

Chief Warrant Officer Lewis Welshofer Junior is accused in the 2003 death of Abed Hamed Mowhoush.

Prosecutors say the general was placed headfirst in a sleeping bag and bound during interrogation, and that he died with an officer sitting on him.

Wellshofer's lawyer had argued that commanders tried to influence the outcome of the case.

Major Robert Short testified at Peterson Air Force Base today that he overheard potential juror and Colonel David Saffold suggest in November that results in previous court-martials were too lenient. Saffold said he did not make such a suggestion.

The judge found Saffold to be a credible witness, and the court-martial will continue.
