Bar Owner Fights Smoking Ban Save Email Print

A Colorado Springs bar owner was in court on Friday fighting tickets he's been issued for violating the statewide smoking ban.

Murray Street Darts owner Bruce Hicks feels the statewide smoking is too vague.

It says no smoking in bars. But doesn't put restrictions on ash trays or cigarette vending machines.

It also doesn't tell bar owners what they're supposed to do when a customer lights up.

That's why he's fighting it.

"At Murray Street Darts we're going to continue smoking until we get this law changed," said Owner Bruce Hicks.

Hicks has been ticketed 23 times for violating the statewide smoking ban.

So far, the court has dismissed 19 of those fines because they were for multiple people all smoking at the same time.

A judge decided on Friday to rule by phone at the end of the month. She says she needs more time to review the case.

When I visit in August I know where I will go. People should have a right to go or not to go into a bar with smoking. Do you know how to make a liberal madd tell him the truth.

I had to check back. I agree with the Screaming Kid issue. I do NOT agree with smoking or drinking around kids. Yet, they're allowed into all places. Even bars! Who decides this? NOT the Gov't. Shouldn't they say something about THAT? Instead, they told me to smoke outside, where the kids are running around, because their parents are ignoring them. Isn't that what playgrounds are for? Here's an idea! FIND A BABYSITTER! Or, if you can't, stay at home & invite your friends over! It's cheaper for you & I'm not annoyed! I don't tell you how to live your life. I hate people littering. I hate people driving slow in the passing lane. I hate people telling me how/where to worship. Welcome to America, where everyone (except a smoker) is supppsed to have a right to live life how they want. Find a place that fits your lifestyle & leave me to mine.

well today it gets even better, seems like the casino owners refuse to enforce the bann on smoking as well.They're tired of losing money$$$ so they let people smoke. Government should stay out of peoples business, especially small business responsible for more jobs than people really know. Let the bar owner decide what's good for his business and they'll make money and pay taxes and the state will enjoy the revenue and the tax money will help everyone who lives in wonderful Colorado. If we would all get together and send the illegals home we'd have less social cost, like hospitals, less demand for gas and the price would go way down. less crime, and more americans would have jobs. In short I'm for enforcing ALL laws and not just some Laws, and also consider what kind of message are we sending our kids ??? Colorado needs to pull it's head out , and FAST !!!

If you don't like to smell like smoke find some place that is smoke free. Simple. There were smoke places before the ban. I don't like going to place where there are screaming kids and kids running around everywhere, and the parents are too lazy to do something about it. How about somebody open up a place that adults can go enjoy a good dinner without hearing screaming kids?

I used to be a smoker and even when I was smoking I still hated smelling like it. I understand people wanting to smoke when you go out but are you really that LAZY that you cant light up outside?

I grew up in Colorado and have moved to Nashville. I must agree with Carrie that it should be up the owners to be smoking or nonsmoking not are government.I come home 2 to 3 times a year to see my family.We where up at Cripple Creek and my dad and some other people outside smoking where talking about how they fought for the freedom of this country and their rights are being taken away more and more everyday.I told them I work at a govenment place and people are not allowed to smoke on the property,but the inmates who come and do work around the place get to take a smoke break on the property.I think they have more rights then the people on the outside.

Normally I would agree with troy in the aspect of the world is taking the control of stuff too far. But the smoking ban is a great thing if smokers want to destroy their lungs more power to them but how rude and unthoughtful is it when they spark up next to someone who cant stand the smell? and troy and paul both seem very ignorant and are the kind who have no care for anyone but themselves!

Illegals that is what always come out of every discussion. To all those who bring it up we aren't going anywhere,get use to it!!! People don't obey a lot of laws but I bet the police are quick to give out ticket$. But who cares about the other stuff that needs to be done things the city can not get $$$ out of!

Maybe the decsion to be a smoking or nonsmoking establishment should reside with the owners, instead of the government imposing even more restrictions on people.

It's his bar if he wants to allow people to smoke good for him. FOr you non smokers if you don't like smoke don't go there. If you don't want to work where there is smoke, guess what don't work there. It really is very simple.

Pete - let the ATF enforce tobacco use violations instead of the Colorado Springs Police. I'd rather and surely the latest crime victim had hoped for.... was Colorado Springs was being better served by it's police force by the focus on securing the safety of it's citizens. Keeping me free from cig smoke it one I handle myself.

Maybe the state should have stayed out of the buisness of infringing on the peoples free will. Individuals should have the option to not go into places where smoking is allowed. Which they do. People should be able to go into places where smoking is not allowed and expect a smoke free environment. Which they can. What is wrong with letting the proprieter of an establishment clearly post smoking or no smoking on the door and let adults decide weather they want to patronize said establishment? I know smoking is harmfull but so is alcohol. This is Colorado not California.

I would have to say that the law makers and law enforcement are wrong this time. Here's why, there have been laws in this country for many years that do NOT allow illegal aliens into this country, and yet no one enforces themand that sends a clear message that we as citizens clearly get to pick and chose which laws we obey and which ones we do NOT. Seems to me he owns his business and he should get to deside to smoke or not to smoke. Illegal people in this country is a far greater law than the smoking ban. Even Bush took an oath to obey the laws of this country so did the sherrif and the police chiefand until they round up and send back all of the illegals there's no way they should do anything about smoking in a bar. Next they'll want to say what's on the menu, or what can be charged for a meal, or maybe how and when I'm supposed to have sex, or where I'm supposed to go to church. Point is it's a stipid law and law enforcement is ignoring important laws.they made the rules to the game.

It's strange how there are now smoking bans in 30 states and many cities, and there don't seem to be too many problems with "enforcing" the ban. It seems to me that this bar owner is likely encouraging people to violate the rules, and making no effort to conform to the rules like everyone else does. Maybe liquor licences should be suspended for those who are openly ignoring the law.
