The battle between Pueblo and Colorado Springs over Fountain Creek continues.
Last week the state fined Colorado Springs Utilities more than 110-thousand dollars for spilling sewage into the creek 21 times since January 2004. Now Pueblo County is suing the municipal-owned utility over those same spills in federal court.
Pueblo alleges the utility violated the Clean Water Act and wants it to pay 32-thousand-500 dollars for each day it broke that law.
The utility says the lawsuit isn't necessary because it's already doing everything the state has required, including performing evaluations of 131 creek crossings, ditches and gullies.
