Colorado Senator Ken Salazar is calling on President Bush to consider appointing a Hispanic or a woman to fill the other open spot on the Supreme Court.
Salazar is one of 13 Democratic senators who have said they will vote to confirm John Roberts as the court's chief justice.
President Bush must now nominate someone else to fill the vacancy left by retirement of Justice Sandra Day O'Connor.
He's expected to do that after the Senate votes Roberts' confirmation on Thursday.
