A mistrial has been declared in the trial of an accused killer.

Joshua Kramer is accused of killing Blaine Steele at a Subway sandwich shop a year and a half ago.

El Paso county district attorney Jeannie Smith said, there was a conflict of interest between the presiding judge and a potential witness.

Kramer could still face the charges, but it will be with another judge.
