The attorney for an Air Force Academy cadet acquitted of raping a classmate on a trip to New Mexico last summer says the case isn't over.
Richard Stevens was planning to argue in court today that an indecent act charge against Benjamin Kuster be thrown out.
Kuster was acquitted yesterday of raping the woman after a night of heavy drinking. But he was convicted of committing an indecent act for having consensual sex with his girlfriend in a room where other cadets slept on the same trip.
Stevens says Kuster's commanding officer brought the charges based on an assurance that if Kuster was acquitted of rape, the other charge would be dropped.
