On Friday the district attorney's office decided not to file felony charges against a University of Colorado student accused of killing a puppy.
District Attorney Mary Keenan says the misdemeanor and felony statutes of the new law read basically the same and it's not fair to punish someone with a felony when they could get charged the lesser penalty.
Garrett Parker Brodie faces three misdemeanor counts of animal cruelty in the death of his girlfriend's 14-week-old black Labrador.
Keenan says her office may bring it's concerns over the new law to the Legislature.
